1. Acceptance of Terms

By accessing or using the Etherly eSIM service (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Etherly eSIM provides digital SIM (eSIM) profiles that enable mobile data connectivity in 120+ countries. eSIM profiles are delivered digitally via QR code and can be activated on compatible devices without a physical SIM card.

3. Account Registration

Accounts are created using a cryptographic seed phrase. You are solely responsible for the security of your seed phrase. We cannot recover or reset your seed phrase. Loss of your seed phrase means permanent loss of access to your account and purchased eSIMs.

4. eSIM Purchase and Activation

• eSIM profiles are delivered instantly after payment confirmation
• Each eSIM profile can only be installed on one device at a time
• Data plans have a fixed validity period starting from the first connection
• Unused data does not roll over after the validity period expires
• eSIM profiles cannot be transferred between accounts

5. Device Compatibility

The Service requires an eSIM-compatible device. It is your responsibility to verify that your device supports eSIM before making a purchase. A list of compatible devices is available on our website. We are not responsible for incompatibility issues.

6. Payment

All payments are made in cryptocurrency and are processed on-chain. Prices are displayed in USD and converted at the current market rate at the time of payment.

7. Refund Policy

Refunds may be issued for eSIM profiles that have not been activated (QR code not scanned). Once an eSIM profile has been activated, no refunds will be issued. Contact us at noreply@etherly.one for refund requests.

8. Acceptable Use

You agree not to use the Service to:

• Engage in any illegal activity under applicable law
• Distribute malware or other harmful software
• Send spam or unsolicited communications
• Attack, disrupt, or compromise other networks or systems

9. Service Availability

Coverage and speeds depend on local carrier networks in each country. We do not guarantee specific speeds or uninterrupted connectivity. Network availability may vary by region and is subject to local carrier conditions.

10. Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Etherly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Modifications

We may modify these Terms at any time. Changes take effect when posted on this page. Continued use of the Service after changes constitutes acceptance.
